INVITATION TO BID
The Town of Yarmouth, Maine (Owner) invites Bidders to submit sealed Bids for the Royal River Park Improvements located near 111 East Elm Street, Yarmouth, Maine.
In accordance with the drawings and specifications presented in this Project Manual, the project consists generally of demolition, renovation, and construction of the Royal River Park current and new amenities including, but not limited to: asphalt paths and parking areas; concrete work associated with ramps, benches, bike racks, and water fountains; preparation for planting beds; fencing and hand rails; electrical conduit; lighting; and more. The project requires installation of stormwater mitigation measures, drainage, tree protection measures, erosion and sedimentation control BMPs, and the application of loam, seed, and mulch.
The Royal River Park Improvements and is partially funded by the Land and Water Conservation Fund (LWCF# 23-00905) and Build America Buy America requirements will apply to all work.
The Work shall be substantially completed by Friday, August 15, 2026 and completed and ready for final payment within 30 calendar days from Substantial Completion.
The resulting Contract for the Project is specifically subject to the laws of the State of Maine.
Drawings and Specifications will be provided electronically to contractors who register as plan holders. Contractors shall notify Karyn MacNeill, Director, Yarmouth Parks, Recreation, & Community Services (YCS) via email at kmacneill@yarmouth.me.us of their intent to bid. Hard copies may also be reviewed at the YCS office Monday-Friday, by appointment.
A non-mandatory pre-bid conference will be held at 1:00pm local time on September 10, 2025 in the Community Room at the Yarmouth Town Hall, rear entrance of 200 Main Street, Yarmouth, ME 04096. A site visit will follow, weather permitting. Bidders are encouraged to attend and participate in the pre-bid conference.
Sealed Bids will be received until 1:00PM local time on Wednesday, September 24, 2025 at the Yarmouth Community Services Dept, located at the front entrance of Yarmouth Town Hall, attn. Karyn MacNeill, YCS Director, 200 Main Street, Yarmouth, ME 04096. Bids will then be opened and read aloud in the Community Room on the main floor of Town Hall. Bids received after 1:00pm on September 10, 2025 will not be accepted.
Questions regarding the work or specifications should be directed to Karyn MacNeill, YCS Director, Yarmouth Parks, Recreation, & Community Services via email at kmacneill@yarmouth.me.us. Questions must be received by 8:00AM local time on Monday, September 15, 2025. An addendum, if required, will be issued by the Owner by Wednesday, September 17, 2025, 4:30PM local time.
Complete sets of Bidding Documents shall be used in preparing Bids; neither Owner nor YCS Director assumes any responsibility for errors or misinterpretations resulting from the use of incomplete sets of Bidding Documents, Bidding Documents or any portion thereof provided by third parties, or for modifications to the Bidding Documents not made by official Addenda, including electronic conversion.
Bid security in the amount of five (5) percent of the Bid must accompany the Bid in accordance with the Instructions to Bidders. Performance and payment bonds shall be required.
The Town of Yarmouth hereby notifies all bidders that it will affirmatively ensure that in any Contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation, and no discrimination shall be made on the grounds of race, religious creed, color, national origin, ancestry, disability, medical condition, marital status, sexual orientation, or gender identity, of such persons.
Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, not to be responsive or responsible or not to meet the specified qualifications or quality requirements, based on poor references or otherwise. Owner may also reject the Bid of any Bidder if Owner reasonably believes that it would not be in the best interest of the Project or the public to make an award to that Bidder. Owner also reserves the right to waive all informalities not involving price, time or changes in the Work. Award is subject to available funding.
